Most of the copyright questions on Branded are about game film. Film is frequently owned by a school, a league, or a film service rather than by the athlete in it, so an athlete uploading their own highlights may still not hold the rights. This is how to raise that with us.

Reporting an infringement

Send a notice to nilbranded@gmail.com with the subject line "DMCA Notice". To be effective under 17 U.S.C. § 512(c)(3), it must include:

Your physical or electronic signature.
Identification of the copyrighted work you say has been infringed.
The URL or profile of the material on Branded you want removed, specific enough for us to find it.
Your name, address, telephone number, and email address.
A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.

Misrepresenting that material is infringing carries liability for damages under 17 U.S.C. § 512(f). If you are not sure whether you hold the rights, ask before filing.

What we do with it

On a valid notice we remove or disable access to the material promptly and tell the user who posted it, passing on a copy of the notice including your contact details. Keep that in mind when deciding what address to write from.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address containing your signature, identification of the removed material and where it used to appear, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your contact details, and your consent to the jurisdiction of the federal court for your district — or, if you are outside the United States, of any district in which Branded may be found.

We may restore the material in ten to fourteen business days unless the original complainant tells us they have filed a court action.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

Trademarks and impersonation

For misuse of a school or organisation name, logo, or brand, or for someone impersonating a person or institution, write to nilbranded@gmail.com with the same level of detail.
